These Terms of Service ("Terms") govern your access to and use of the NOMA Interiors website, online store, and the purchase of products from NOMA Interiors ("NOMA", "we", "us", or "our").
By accessing our website or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use our website or place an order.
These Terms should be read together with our Privacy Policy, Shipping Policy, and Returns & Refund Policy, which form part of the terms governing your use of our store and your purchase from NOMA.
1. About NOMA
NOMA Interiors is a South African interior wall-art brand offering premium, made-to-order artwork and related interior products.
NOMA operates its online store from South Africa and serves customers internationally.
Our products are produced on demand through third-party print and fulfilment partners. Depending on the product and destination, an order may be produced and dispatched from a fulfilment facility located in South Africa or another country within our fulfilment network.
The country from which an order is produced or shipped does not necessarily correspond to NOMA's country of operation.

2. Use of Our Website
You may use the NOMA website for lawful purposes and in accordance with these Terms.

3. Product Information
We make reasonable efforts to ensure that product descriptions, dimensions, photographs, colours, materials, finishes, and other product information displayed on our website are accurate.
However, certain variations may occur between a digital representation of an artwork and the finished physical product.
Differences may result from:
- Screen and display settings;
- Lighting conditions;
- Printing processes;
- Natural characteristics of materials;
- Canvas or frame construction;
- Production tolerances; and
- Differences between individual production batches.
Such minor variations do not necessarily constitute a defect.
Where a product contains a material defect, production error, or fulfilment error, your rights are addressed in our Returns & Refund Policy and applicable consumer protection legislation.
4. Made-to-Order Products
NOMA products are made to order.
This means that products are generally produced only after an order has been placed rather than being held as conventional retail inventory.
Because products are produced specifically for each order:
- Orders may enter production shortly after being placed;
- Cancellation may not be possible once production has begun;
- Change-of-mind returns may not be available;
- Product availability may depend on our fulfilment network; and
- Production and delivery times may vary.
Please carefully review the product, size, finish, quantity, delivery address, and other order details before completing your purchase.
Your cancellation and refund rights are set out in our Returns & Refund Policy and remain subject to any mandatory rights provided by applicable law.
5. Orders
When you place an order through our website, you are making an offer to purchase the selected products in accordance with these Terms.
After placing an order, you will generally receive an order confirmation by email.
An order confirmation confirms that we have received your order. It does not necessarily mean that the order has entered production or that the order cannot subsequently be cancelled where cancellation is legally or operationally possible.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- There is an obvious pricing or product-information error;
- We suspect fraudulent or unauthorised activity;
- We are unable to fulfil the order to the requested destination;
- Payment cannot be successfully processed; or
- Circumstances outside our reasonable control prevent fulfilment.
If we cancel an order after payment has been received, we will provide an applicable refund in accordance with these Terms and applicable law.
6. Pricing
Prices displayed on the NOMA website are presented in the currency applicable to your selected market or shopping experience.
NOMA may use currency conversion and international pricing functionality to display prices to customers in different currencies.
Exchange rates may change over time.
The final price payable by you will be the amount displayed at checkout before the order is submitted, together with any applicable shipping charges and other charges disclosed at checkout.
Where applicable, taxes may be included in or added to the displayed price depending on the destination, applicable law, and checkout configuration.
NOMA reserves the right to correct obvious pricing errors.
If an obvious pricing error occurs and an order has been placed at an incorrect price, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order and receive an applicable refund.
7. Payments
Payments are processed through the payment methods made available at checkout.
By submitting an order, you confirm that you are authorised to use the payment method provided.
Payment must be successfully authorised before an order can enter production.
We do not store complete payment-card details on our own systems where payment processing is handled by a third-party payment provider.
Your payment may be processed or settled in a currency different from the currency in which the product price was displayed, depending on the payment method, payment provider, currency configuration, and applicable banking arrangements.
Any currency conversion performed by a payment provider, bank, card issuer, or other financial institution may be subject to that provider's exchange rate or fees.
8. Shipping
Orders are fulfilled through NOMA's fulfilment network and third-party shipping providers.
Available shipping methods, costs, and estimated delivery times depend on the product and destination.

9. Customs, Duties and Import Taxes
International orders may be subject to customs duties, import taxes, VAT, GST, customs clearance charges, carrier fees, or other charges imposed by the destination country.
Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer.
NOMA does not control the amount or application of such charges.
The payment of a shipping fee does not necessarily mean that customs duties or import taxes have been prepaid.
Customers are responsible for complying with the import requirements applicable to their destination.
Refusal to pay applicable customs charges may result in delivery delays, return of the shipment, or other consequences and does not automatically entitle the customer to a refund.
10. Returns, Refunds and Defective Products
Because NOMA products are made to order, we generally do not accept returns or refunds solely because a customer has changed their mind or selected an incorrect product, size, finish, or option.
However, this does not limit any consumer rights that cannot legally be excluded.
Where an order arrives damaged, defective, incorrect, or materially different from what was ordered, NOMA will assess the matter and may provide an appropriate remedy in accordance with our Returns & Refund Policy and applicable law.

11. Intellectual Property
All intellectual property appearing on or through the NOMA website is owned by NOMA, its licensors, or other applicable rights holders unless otherwise stated.
This includes, but is not limited to:
- NOMA's name and branding;
- Logos and trademarks;
- Artwork;
- Product designs;
- Photographs;
- Mock-ups;
- Website design;
- Written content;
- Graphics;
- Product descriptions;
- Marketing materials; and
- Other original creative content.
You may view and use the website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, sell, license, publish, create derivative works from, or commercially exploit NOMA's intellectual property without our prior written permission.
Purchasing a physical NOMA artwork does not transfer ownership of the underlying copyright or other intellectual property rights in the artwork to the customer unless expressly agreed otherwise in writing.
12. Customer Reviews and Submitted Content
If you submit a review, photograph, testimonial, comment, or other content to NOMA, you confirm that:
- You have the necessary rights to submit the content;
- The content does not infringe another person's intellectual property, privacy, or other rights;
- The content is not unlawful, defamatory, fraudulent, or misleading; and
- The content does not contain malicious software or harmful material.
By submitting content for publication, you grant NOMA a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and publish that content for legitimate business and marketing purposes.
We reserve the right to remove or decline to publish submitted content where we reasonably consider it inappropriate, unlawful, misleading, or inconsistent with our brand or website standards.
13. Third-Party Services
NOMA uses third-party service providers to operate aspects of our business, which may include:
- E-commerce and website platforms;
- Payment processors;
- Print and fulfilment providers;
- Shipping and courier companies;
- Email and communication services;

Nothing in these Terms is intended to remove or reduce any mandatory consumer rights or remedies that apply to your purchase.
17. Events Outside Our Control
NOMA will not be responsible for a failure or delay in performing an obligation where the failure or delay results from circumstances reasonably beyond our control.
These circumstances may include:
- Natural disasters;
- Severe weather;
- War or civil unrest;
- Government action;
- Customs restrictions;
- Carrier disruptions;
- Strikes;
- Labour disruptions;
- Significant technical failures;
- Cybersecurity incidents;
- Power or telecommunications failures;
- Supply-chain disruptions;
- Production disruptions; or
- Other events that could not reasonably have been prevented or controlled by NOMA.
Where reasonably possible, we will take appropriate steps to minimise the impact on affected customers.

By using our website or placing an order, you acknowledge that you have read our Privacy Policy.

These Terms are governed by the laws of the Republic of South Africa, except to the extent that mandatory consumer protection laws in the customer's jurisdiction provide otherwise.
Nothing in this section is intended to deprive a consumer of mandatory rights or protections that cannot legally be excluded under the laws applicable to their transaction.

Changes will not retrospectively alter rights or obligations that have already accrued under an order unless required or permitted by applicable law.

The remaining provisions will continue to apply.
